In this agreement "We", "us" and "our" refers to Skoshh (Skoshh, LLC). By visiting our site, you agree to the terms & conditions stated here.

By visiting the Website and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. 

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service. 

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes. 

E-COMMERCE STORE TERMS 

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.  This website is not intended for persons under 18 years of age.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). A breach or violation of any of the Terms will result in an immediate termination of your account and Service.

PURCHASES

Skoshh offers information on our products and the ability to place your order for such products. Order acceptance and the completion of a contract between you and Skoshh (“Contract”) will take place only when you make full or part payment at checkout, unless you cancel the order prior to completion, or we do not accept it or later cancel the order in accordance with our terms below. 

You agree to pay the amounts displayed to you at the time of purchase, as well as any applicable taxes and fees. You agree to pay the full price for all Products you purchase from the Website. We reserve the right to charge extra charges for your credit card or PayPal account for any products purchased from the Website. You are responsible for the timely payment of all fees and for providing us with a valid credit card or PayPal account details for payment of all fees.

ACCOUNT TERMS

By registering with the Website you can access or view the prices, product inventories, and submit purchase orders electronically. You are responsible for using the Website in a private and secure manner. We will not be liable for any damage or loss caused from any unauthorized account access resulting from your actions, such as not logging out of the account or sharing your account password. We reserve the right to refuse registration or cancel an account at any time.

RULES OF CONDUCT

(d) Harass, threaten, abuse, cause harm, be profane, vulgar, obscene, excessively violent racially, ethically or otherwise objectionable or offensive in any way;

(d) Account sharing, including without limitation, letting third parties use your account and password;

(e) Use the Site of Services to spam any third-party or engage in commercial activities within the Site with third parties;

(g) Use the Site’s content to engage in commercial activities;

(h) Provide false or deceptive information;

(i) Delete, add or otherwise change other people’s entries or other Content when you have not been granted the privileges to do so; or

(j) Allow usage by others in such a way as to violate these Terms of Use.

Skoshh reserves the right, at its sole discretion, to change, modify, revise, add or delete any of the terms contained in these terms & conditions, at any time, without notice or liability. Any such modifications or changes will immediately become effective upon posting of such changes. Your continued access or use of this Website will imply your full acceptance of the same. You are therefore responsible for regularly reviewing these Terms & Conditions and additional terms or notices posted on the Website Website. Your continued use of, access to or browsing of the Site following the posting of changes to the Terms of Use means that you accept and agree to the changes regardless of whether or not you actually reviewed them. 

Skoshh shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Site. Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order). We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated. 

INTELLECTUAL PROPERTY RIGHTS & CONTENT OF THE SITE

The content on the Site, other than User Submissions (as defined below), including the text, slogans, trademarks, graphics, and photos created by and for Skoshh and interactive features, as well as the “look and feel” of the Skoshh Site (collectively "Content"), the related copyrights, trademarks, logos and other intellectual property rights contained therein ("Marks"), and all intellectual property rights, including copyright and design rights, in the product Designs, are owned by or licensed to Skoshh subject to copyright and other intellectual property rights.

Content on the Site is provided to you on an “AS IS“ and “AS AVAILABLE” basis for your information and personal use only without any representations or warranties being made by Skoshh regarding the Content.

You agree to not engage in the use, copying, reproduction, transmission, broadcast, display, distribution, sale, licensing or otherwise exploitation of any of the Site’s Content or User Submission (as defined below) other than expressly permitted herein. Skoshh reserves all rights not expressly granted in and to the Site and the Content contained therein.

You agree not to disable, circumvent or otherwise interfere with security related features of the Site or features that prevent or restrict use or copying of any Content or enforce limitations on the use of the Site or the Content therein. You are prohibited from accessing the Site or using the Services for the purpose of creating any product or service.

You acknowledge and agree that any materials, including, but not limited to questions, comments, suggestions, ideas, plans, notes, drawings, original or creative materials or other information, regarding the Site or Services that you provide via email or other means (“Feedback“) are non-confidential and shall become the sole property of Skoshh.

You hereby assign to Skoshh the exclusive rights, including all intellectual property rights, in all Feedback and Skoshh shall be entitled to the unrestricted use and dissemination of these materials for any purpose, commercial or otherwise, without acknowledgment or compensation to you.

COPYRIGHT INFRINGEMENT

In your use of and interactions with the Site, you may not post, modify, distribute, or reproduce in any way any User Submission that is copyrighted material belonging to others, without obtaining their prior written consent. This specifically includes the submission of a Design. Skoshh reserves the right, in its discretion, to remove any User Submission if we believe it may infringe the copyright rights of others, and/or to terminate the accounts of users who we believe to be infringers.

If you believe that your work has been copied or posted on the Site in a way that constitutes copyright infringement, send us a written communication that includes substantially the following (please consult your legal counsel or the Copyright Act to confirm the below requirements):

A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.

Skoshh grants you a non-exclusive, non-transferable, limited license to access and make use of the contents or information available on the Website for your personal use and not to download or modify it, or any portion of it, except with the expression written consent of Skoshh. 

However, these Terms of Use, and any rights and licenses granted hereunder, may be assigned, transferred, delegated, and sublicensed by Skoshh.

As part of the Service, we may provide you with convenient link(s) to third party website(s) (“Third Party Sites”) as well as content or items belonging to or originating from third parties (the “Third Party Applications, Software or Content”). If you decide to leave the Site and access the Third Party Sites or to use or install any Third Party Applications, Software or Content, you do so at your own risk and you should be aware that our terms and policies, including these Terms of Use, no longer govern. RELEASE AND INDEMNIFICATION

You agree to defend, indemnify and hold harmless Skoshh, its subsidiaries, affiliates, directors, officers, shareholders, employees, licensors, agents or operators of Skoshh, from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including legal fees) arising from: (i) your use of and access to the Site; (ii) your violation of any term of these Terms of Use; (iii) your violation of any third party right, including any copyright, property, or privacy right; or (iv) any claim that one of your User Submissions caused damage to a third party. This defense and indemnification obligation will survive these Terms of Use and your use of the Site.

APPLICABLE LAW

By visiting the Website, you agree that the laws of the state of Las Vegas, Nevada USA,  without regard to principles of conflict of laws, will govern these Terms & Conditions and any dispute of any sort that might arise between you and Skoshh.

DISPUTE

Any dispute relating in any way to your visit or access of the Website or to the products you purchase through the Website shall be submitted to binding arbitration in New York City, New York state. Arbitration under these Terms & Conditions shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under these Conditions of Use shall be joined to an arbitration involving any other party subject to these Conditions of Use, whether through class arbitration proceedings or otherwise. 

GENERAL

No waiver of any term of these Terms of Use shall be deemed a further or continuing waiver of such term or any other term, and Skoshh’s failure to assert any right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

You agree that any cause of action arising out of or related to the Site must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us. 

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms. 

SHIPPING POLICY

We offer free ground shipping on all domestic orders over $50.

 If your order is under $50, you flat rate shipping fee of $6.95 if you are located within the continental U.S. 

Please make sure to check the Estimated Shipping Date on the product page for when your order is expected to ship out from our warehouse. Please note that processing times vary per item. Once an order is processed, it is usually dispatched within 1-3 business for US orders and 3-5 days for International orders. Once your order is shipped, we estimate you will receive your order within 3-8 business days of its ship date if you are located in the United States. If you wish to receive your item(s) sooner, please select one of our expedited shipping options at checkout.

RETURNS & EXCHANGES

This Returns and Exchanges Policy applies to all purchases made through the website

Skoshh.com. 

Our Policy (U.S. Customers Only)

Purchases are valid for exchange, credit, or refund within 30 days from the ship date. If you decide to return your piece, please reach out to us within 30 days to start your return process. Your package includes an invoice of the order, customs documents (if applicable) and products you ordered via us. To be eligible for a return, the piece must be sent back in its original condition, and unworn with the security sticker still attached. Your return form and invoice provide a postmark date that specifies the last day you have to return your merchandise by mail.

 

Please note that the return label is pre-paid, therefore, you will be responsible for the return handling charge of $6.95 which will be deducted from your refund. In addition, any shipping charge paid by you is non-refundable. If you wish to use your own shipping label, $6.95 handling fee will be still deducted from your refund. Enter your information at this link here, or alternatively email us at customerservice@Skoshh.com to initiate your return and we will send you a shipping label.

 

The refund amount will include only the amount paid by you after any discount or reward is applied to the returned item(s) and it will not include any shipping charge paid by you. Please allow 2-3 weeks from the return ship date for your account to be credited, and 1-2 billing cycles for the credit to appear on your statement. Returns from APO/FPO addresses, please an additional 2-3 weeks from the return ship date for your account to be credited, and 2-3 billing cycles for the credit to appear on your statement. Return will be processed in the original form of payment.

We do not accept returns in our office at this moment.

If you received a defective, damaged, or the wrong item(s), please contact us at customerservice@Skoshh.com immediately with photos of damages/wrong item(s). We will do our best to facilitate your return process as soon as possible. 

International Customers

Unfortunately at this time, all orders purchased by customers who live overseas will not be eligible for a return and are considered final sale. We apologize that we can’t accept returns from our international customers--we’ll do our best to make this happen in the near future!

Exchanges

If you want to swap your piece out for something else, please contact us customerservice@Skoshh.com to initiate the exchange. To be eligible for an exchange, the piece must be unworn, with the security tag still attached, and sent back in its original packaging. Please note that all exchanges are subject to a $6.95 return shipping fee.

Gift Return

If you received a Skoshh item as a gift and wish to return, reach out to us at customerservice@Skoshh.com to initiate the return process. We will email you a prepaid label (a return shipping fee of $6.95 applies). 

The refund amount will include only the amount paid at the purchase after any discount or reward was applied to the returned item(s) and it will not include any shipping charge paid by you unless you are returning a damaged, defective, or the wrong item was sent to you.

Once we receive your item, we'll send you your refund in the form of store credit for the full purchase price, less the return shipping fee via email.

Exclusions

Returns are accepted for the majority of our products with the exception of the following:

 

SALE MERCHANDISE, COSMETICS, UNDERWEAR, SELECT LINGERIE AND SWIMWEAR, EARRINGS, BODY PIERCINGS, AND GIFT CARDS / E-GIFT CARDS ARE ALL FINAL SALE ITEMS AND CANNOT BE RETURNED OR EXCHANGED, UNLESS REQUIRED BY LAW.

 

-Final Sale items: Any piece listed as final sale within the Additional Product Information section on the product page.

-Sale items: Any item purchased at a discount of 50% or greater will be considered final sale

Personalized jewelry: All initial jewelry, jewelry containing numbers, monogrammed and engraved items.

-Specialized orders: If we order a piece in a gold color, custom chain length, or ring size that we do not carry on our site

-All Piercing Earrings used for piercing appointments 

Pieces that we cannot accept returns for are marked as final sale on their product page to ensure complete transparency. Please read this carefully before making your purchase!

 

Refunds take approximately one week to process, and depending on your credit card, it can take 5 - 7 days for the refund to post to your account. Where applicable, special outbound shipping charges are not refunded.

 

We’re really proud of our extended return period, and to ensure we can continue offering this to our customers, we do monitor returns made by customers. Continued returns will be flagged and future orders potentially refused at our discretion

Late or missing refunds (if applicable) 

If you haven’t received a refund yet, first check your bank account again. 

Then contact your credit card company, it may take some time before your refund is officially posted. Next contact your bank. There is often some processing time before a refund is posted. If you’ve done all of this and you still have not received your refund yet, please contact us at customerservice@Skoshh.com.
